These conditions have been prepared in accordance with the provisions of Law 34/2002, of services of the information society and electronic commerce, Law 7/1998 on General Conditions of Contract, the Royal Legislative Decree 1/2007 approving the revised text of the General Law for the Defense of Consumers and Users in its latest amendment contained in Law 3/2014 of March 27, Law 7/1996 on the Regulation of Retail Trade and as many legal provisions are applicable.

The user, with the acceptance of the terms and conditions, declares to know and accept the procedures set forth herein as necessary to proceed with the purchase.

PRODUCT INFORMATION

The information given about each product, as well as the photographs or videos related to them and the trade names, trademarks or distinctive signs of any kind contained in the Cold Culture website, are shown in www.coldcultureworldwide.es as a guide.

Size guides shown in the Cold Culture website are for indicative purposes only, sizes may vary by 2 cm.

 

PRE-PURCHASE INFORMATION

All users will be able to visualize within the website, classified by categories and subcategories, the totality of products offered for purchase. By clicking on each one of them, the user will be able to access a complete product sheet where a brief description, its availability and price will be indicated. Users are informed that all data provided in the description of the products are based on the information provided by their suppliers.

All prices are shown in Euros and include the applicable V.A.T. and/or any other applicable tax. These prices will be at all times those in force, with the exception of any obvious typographical errors. The transport is not included in the prices shown for the products, breaking down its cost later at the time of completion of the purchase.

The user is informed that the product purchased through this website may undergo, due to the availability of the manufacturer, non-substantial changes in the components, features or performance of the lot that integrate it, provided they do not involve a demerit of the qualities and performance advertised.

The user needs to note that once the order has been placed, shipping information cannot be changed.

 

PURCHASE SYSTEM

The procedures to carry out the acquisition of products will be those shown on the screen at all times and described in these General Conditions. Users may register as members of KIKILLO PIECES SL during the product purchase process to enjoy promotional benefits. In the same way, the user is provided with a purchase method without the need to register with KIKILLO PIECES SL, in which an email address will be requested.

To proceed with the acquisition of the products, the user must click "Add to cart" on each product. As the user selects what they want, they will be able to preview the “Cart” in the upper right part of the website with the products pending payment, which will be updated as products or services added. If the user wishes to see their order in more detail, they can click on “Cart” and a section will open on the screen where they can see a summary of the selected products. From there you can click on "Finish order" again to continue with the purchase process.

On the Information screen, the user may make use of a discount voucher that KIKILLO PIECES SL has given him derived from a promotion, raffle or other circumstance. To validate it, you must click on "Use" and you will see the discount in the price breakdown, as long as it is still valid according to your particular conditions. You must complete the information as requested and select, if applicable, the delivery and billing address.

When the user has finished, they must click on the "Continue with shipments" button that you will find at the bottom of the breakdown of your purchase. You must complete the information as requested and select a type of shipment. To continue with the purchase process, you must click on the "Continue with the payment" button. It will take you to the last page where you must fill in your payment details and click on pay now.

 

PAYMENT SYSTEM

Payment can be made by credit or debit card, Visa, MasterCard or AmericanExpress. The user will be able to choose the payment method at the end of the purchase, and both payments will be subject to the following conditions:

Payment by credit card will be made through a payment gateway managed by a bank with a secure server certified according to the SSL protocol. The bank details entered are encrypted and securely transmitted to the services of the bank and are subsequently verified with the issuing bank to prevent possible fraud and abuse. KIKILLO PIECES SL does not have bank details or the credit or debit card used by the user to make the purchase.

When the amount of the purchase has been charged fraudulently or improperly using the payment card number, it will give the buyer the right to demand the immediate cancellation of the charge. However, if the purchase had actually been made by the cardholder buyer and the return requirement was not a consequence of having exercised the right of withdrawal or resolution, the buyer will be obliged to the business owner to compensate for the damages caused as a consequence of said cancellation.

Once the payment method has been selected and the order has been completed, KIKILLO PIECES SL will always send an email to the user confirming the order.

 

ORDER SHIPPING

Shipping costs are proportional to the weight, the destination of the package and the shipping method will be borne by the buyer. These expenses will be displayed in the cart before proceeding with the purchase.

KIKILLO PIECES SL emphasizes the responsibility of the user to enter a complete and correct delivery address. At the time of dispatch of the distribution order, the customer will be informed of this fact and the carrier will activate the tracking functions to guarantee delivery.

KIKILLO PIECES SL ships throughout the Spanish territory, including the Balearic and Canary Islands, Ceuta and Melilla. In addition, it also ships worldwide at an additional cost.

SEND CONDITIONS

The customer will be responsible for verifying the content and condition of the merchandise at the time of delivery. Once your signature has been accepted and entered on the copy of the delivery note to be returned to the carrier, you will have expressed your agreement with what was received and waived any subsequent claims about the suitability and identity of the merchandise requested and received. In the event that the customer verifies errors in the merchandise received or that it is visually damaged at the time of delivery, he must record these circumstances on the carrier's delivery note and must inform us of these facts within 24 hours.

 

TAXES AND OTHER CHARGES

In the case of import fees and/or customs procedures, these expenses will be borne by the buyer.

APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION

Any dispute arising out of or in connection with the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts.

If you are contracting as a consumer, nothing in this clause shall affect your rights as a consumer under current legislation.
